Comet Terms and Conditions

1. Acceptance
By creating an account or using Comet ("the app"), operated by Aerolith Technology Inc. ("Aerolith", "we", "us", "our"), you agree to these Terms and Conditions. If you do not agree, please do not use the app.
2. Who can use Comet
A swimmer aged 14 or over may register and consent for themselves. For a swimmer under 14, an account may be created only by a parent or guardian, who consents on the swimmer's behalf and is the account holder. We apply this single threshold of 14 everywhere we operate.
The parent or guardian who holds a minor's account is the contracting party under these Terms and is responsible for supervising the swimmer's use of the app. The swimmer is an authorized user under that account.
3. Your account
You can create your account by email or through Apple ID or Google. You are responsible for the accuracy of your profile information, in particular your date of birth, which determines your age category and the application of the protections for minors.
If you hold an account, you are responsible for keeping your login details secure and for activity under your account. Where the account belongs to a swimmer under 14, the parent or guardian who holds the account carries that responsibility. Swimmer accounts are read-only and show only the swimmer's own data. Please tell us promptly if you suspect unauthorized use.
4. The service
Comet lets swimmers view their own training sessions, times, splits, and related metrics. We may add, change, or remove features over time.
5. Demo mode and sample content
The app offers a demo mode populated with fictional sample swimmers, accessible without an account, as well as an option letting subscribers view that sample data from their profile. This data is provided for illustration only: it is neither real data nor a promise of results. In demo mode, the stopwatch runs without recording and features requiring an account or a subscription are unavailable.
6. Acceptable use
You agree not to misuse the app, including by attempting to access another user's data, interfering with the service, or using it for any unlawful purpose.
7. Your data and content
You keep your rights in the swim data associated with the account. You grant us the limited permission we need to store and display that data, as described in our Privacy Policy. Our handling of personal information is governed by the Privacy Policy.
8. Joining a club
If you connect your account to a swim club, you consent to that club viewing your performance information under the terms described in our Privacy Policy (cometswim.com/privacy). Joining is voluntary, can be declined without any consequence for your use of the app, and can be revoked at any time from your profile. The dashboards offered to clubs are view-only: no club can modify your data or act on your account.
9. Intellectual property
The app, including its software, design, and branding, belongs to Aerolith Technology Inc. or its licensors. You may not copy, modify, or distribute it except as allowed by law.
10. Third party services
The app may rely on third party services, for example hosting and analytics. We are not responsible for those third parties' own services or terms.
11. Comet+ subscription (auto-renewing)
Plans. Comet+ is offered as an auto-renewing subscription: an annual plan (USD $60.00 per year) or a monthly plan (USD $9.95 per month). The prices shown in the app at the time you subscribe prevail; this includes local currency display by the App Store or Google Play.
Free trial. The annual plan includes a seven (7) day free trial and the monthly plan a three (3) day free trial. At the end of the trial, the subscription converts automatically and the price of the chosen plan is charged to the payment method associated with your Apple or Google account, unless you cancel at least 24 hours before the end of the trial. Only one free trial is offered per Apple or Google account, across all plans.
Renewal and cancellation. The subscription renews automatically each period, unless you cancel at least 24 hours before the end of the current period. Cancellation is done in your Apple account settings (Settings > Subscriptions) or Google Play (Payments and subscriptions); deleting the app does not cancel the subscription. Cancellation takes effect at the end of the paid period: you keep full access until then.
Billing and refunds. Billing is handled by Apple or Google under their terms. Refund requests are submitted directly to Apple or Google and governed by their respective policies.
Expiration. When the subscription expires, the app returns to demo mode. Your training data is retained and becomes accessible again as soon as you resubscribe.
Price changes. We may change subscription prices. Any change is communicated to you in advance through the App Store or Google Play mechanisms and applies only from the next renewal; you can cancel before it takes effect.
12. No coaching or medical advice
Comet provides tracking and information only. It does not provide medical, health, or professional coaching advice. Decisions about training and health should be made with a qualified coach or healthcare professional.
13. Disclaimers
The app is provided "as is" and "as available." To the extent permitted by law, we disclaim warranties that the app will be uninterrupted, error free, or fit for a particular purpose.
14. Limitation of liability
To the extent permitted by law, Aerolith Technology Inc. is not liable for indirect, incidental, or consequential damages arising from your use of the app. Nothing in these Terms limits liability that cannot be limited by law.
15. Suspension, termination, and account deletion
The account holder may stop using the app and close the account at any time. We may suspend or end access if these Terms are breached or if we discontinue the service. On termination, we handle your data as described in the Privacy Policy.
You can delete your account at any time from the app. Deletion erases your personal information as set out in our Privacy Policy, except for billing and subscription records, which are kept for seven (7) years under our legal obligations. Deleting the account does not cancel an ongoing subscription: cancellation must be done separately with Apple or Google (see Section 11).
16. Changes to these Terms
We may update these Terms. We will post the updated version with a new date and version number. Continued use after an update means you accept the change.
17. Governing Law, Forum, and Dispute Resolution
Governing law. These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
Forum and venue. Subject to the arbitration provision below, you and Aerolith agree that the courts of the judicial district of Terrebonne, Province of Quebec, have exclusive jurisdiction over any dispute, and you consent to the personal jurisdiction and venue of those courts.
Arbitration on demand. Either party may elect to resolve a dispute by binding arbitration rather than in court. Where a party demands arbitration in writing, the dispute will be referred to and finally resolved by a single arbitrator under the Arbitration Rules of the ADR Institute of Canada (ADRIC), seated in Montréal, conducted in French, with the arbitrator's decision final and binding. Absent such a demand, the courts identified above retain jurisdiction. Nothing in this section requires either party to arbitrate, and either party may seek injunctive or interim relief from a court at any time.
Mandatory consumer rights preserved. Nothing in these Terms waives, limits, or overrides any right or protection that applicable consumer-protection law grants you and that cannot lawfully be waived, including any non-waivable right to bring or defend proceedings in your place of residence.
Language. These Terms are drawn up in French. A version in another language may be provided for convenience; in the event of any conflict or discrepancy, the French version prevails.
